It is agreed between Seller and Buyer as follows:

DESCRIPTION OF DOG

The dog sold pursuant to the terms of this agreement is as follows:

BUYER’S REPRESENTATIONS
The following conditions apply to the sale of the aforementioned dog: 

The Buyer has FIVE days from the time of the purchase to have the dog examined by a veterinarian and to personally inspect the dog. Any request to return the dog to the Seller must be made within this time period, and must be accompanied by a written statement from a veterinarian describing all problems found. Failure to have the puppy examined within 5 days voids the health warranty. A warranty against life threatening genetic defects is provided. Reimbursement will be full purchase price, if within the first two weeks of purchase and 50% of the purchase price thereafter up to two years of age. Genetic defects that qualify for reimbursement are those related to hip, heart, eye or life-threatening issues. Reimbursement for genetic defects will be made only when a second opinion from a qualified veterinarian and proof of surgery expenses are provided. In the rare case of death, the puppy will be replaced free of charge if under 2 years of age. A necropsy report completed by a qualified vet must show the cause of death was caused by a genetic issue. Warranty is void if necropsy is inconclusive or indeterminable.

This warranty does not include viral infections, infections, improper bites, hernias, hypoglycemia, Giardia or Coccidiosis or reactions to vaccines or sutures, ingestion of foreign objects, food, chemicals or physical injury, as well as other issues not listed. Shipping fees are at the Buyers expense. Seller agrees to rehome the dog should the original purchaser so request. Warranties will apply only to the original purchaser. This warranty is void in the event of an indeterminable or inconclusive diagnosis. Transfer of dog ownership shall void all such provisions of this agreement. 

Raylin Danes provides a certificate for 30 days of free health insurance through Trupanion that has to be activated by the customer. Any warranty issues within the first 30 days will be paid out only for the deductible incurred. It is your responsibility to enroll your puppy within the first 24 hours of possession with Trupanion to enact this free coverage. 

If this puppy is being sold as a pet/companion, with no intention of being shown, this dog will be sold with an AKC Limited Registration. The Buyer agrees to begin the dog's AKC registered name with the Seller's kennel name, Raylin Danes.  The dog must be spayed or neutered by 15 months of age, but not before 1 year of age. Failure to do so will void the health warranty. Proof of spay/neuter must be provided to Raylin Danes within 30 days of procedure being completed to maintain your warranty. Failure to have this dog spayed or neutered prior to 15 months of age will require purchaser to pay Seller five times the purchase price. Proof of spaying/neutering by 15 months year of age must accompany any request for warranty reimbursement. 

If this puppy is being sold as a pet/companion it does not convey with breeding rights. If this puppy is bred, the purchaser agrees to pay the Seller ten times the purchase price of this puppy for every litter produced. All legal fees to enforce this contract will be the responsibility of the Buyer. 

If this puppy is being sold as a show prospect, it is understood that the buyer will make every effort to show this dog to its AKC Championship.  The Buyer agrees to begin the dog's AKC registered name with the Seller's kennel name, Raylin Danes. If the Buyer’s puppy is a bitch, Buyer agrees to co-own and to make every effort to co-breed their bitch with Raylin Danes, if the Seller so wishes and if the bitch passes the following health clearances: OFA hips, heart, eyes and thyroid.  The Seller will be responsible for choosing the stud dog who will be the best mate for the bitch.  Both parties will mutually agree upon the details regarding whelping, raising and selling the litter.  The Seller maintains the right, at no cost to the Seller to take the second pick puppy from the bitches first litter.  The Seller pays all cost associated with picking the puppy up and the cost of the ear crop.  If the buyer puppy is male, OFA hips, heart, eyes and thyroid must be passed before this dog is bred.  If the puppy is male, the Buyer agrees for the Seller to retain breeding rights of said Great Dane, with expenses involved with using the dog at stud (i.e., collecting and shipping) being the sole responsibility of the Seller.  The Seller retains the right to collect and solely own the rights to the dog’s semen.  The Seller agrees that any bitch bred to the stud dog will be owned or co-owned by the Seller.

Under no circumstances shall the Seller be liable to the Buyer or any third party for a dog that has been subjected to abuse, accident, negligence or misuse. Also, under no circumstances shall the Seller be liable for any consequential incidental or special damages resulting from or in any manner related to the dog. 

Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the Buyer.

CONSIDERATION

This dog, identified in Section 1 is being sold for the sum of $________________ payable in full at the execution of this contract. In the event that said funds are not readily collectible by the Seller, for example, a refusal by a bank to honor a check tendered by the Buyer for the dog, the parties agree that the Seller shall have the right to recover from the Buyer all reasonable attorney’s fees and court costs incurred in connection with obtaining full payment. 

MAINTENANCE

Buyer agrees to maintain this dog in good health, provide preventative health care including, but not limited to, inoculation, internal parasites, and heartworm and flea preventative. It is agreed that your Great Dane will be housed indoors and fed a quality food, agreed upon by the Seller. It is also agreed that you will maintain the dog at a healthy weight, and that the dogs coat will be properly groomed. 

Buyer agrees to postpone strenuous repetitive exercise (such as agility training or road work exercise) until a minimum of eighteen months of age. Buyer agrees to provide basic obedience training within the first year of ownership. Buyer agrees never to place this dog in a shelter, pound or similar facility including a research laboratory. In the event Buyers address/phone #’s change, Buyer will inform Raylin Danes immediately. 

Buyer agrees to inform their veterinarian that Seller, as this dogs breeder, will be entitled to discuss this dog’s health with the dog’s veterinarian at any time.

If at any time it should become necessary to find a new home for this dog, Buyer shall first contact the Seller for assistance in placement.  The Buyer fully understands that he/she SHALL NOT RESELL, give away, or in any other way place this animal into a home without the written permission of the Seller (received in writing not more than 14 days after contacting the Seller).  Otherwise, the dog must come back to the Seller with NO MONIES EXCHANGED and with the AKC Registration papers intact and signed back over to the Seller.  The Seller shan then determine what is best for the dog.

SELLER’S REPRESENTATIONS

The Seller guarantees that this Great Dane is purebred and registerable with the American Kennel Club.  The Seller guarantees that this Great Dane is not suffering from any illness at the time of sale, and that the puppy is freeof worms or the Seller will pay for the worm medication.  If this puppy is being sold as a show prospect, Seller does NOT warranty that the dog is free of all AKC show faults.

FULL AND FINAL AGREEMENT 

The parties agree that this writing represent the entire Agreement between them and that no other representations, either oral or written have been made regarding the dog described above. The parties further agree that no changes in this contract shall be binding upon either of them without written notifications signed by both parties. 

Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of New Jersey, in the county of Burlington. It is agreed the place of venue shall be in Burlington County, New Jersey.
